First offenses generally have a lesser penalty than for those with previous
convictions for DUI. Typically the penalty can be a fine of around
$300 and a possible jail sentence of 90 days. The most important
evidence in determining a case of DUI is the blood alcohol test which
tells how much alcohol is present in your system at the time of
arrest. This level should be no more than.08%, any more than this and
the defendant could be facing a mandatory jail sentence of between
five and ten days.
For
those with previous convictions the penalties will be come more
severe depending on how may times you have offended. If you offend
within 15 years of the first offense then there is a fine of between
$1,000 and $5,000 with a possible jail sentence of at least five days
or even thirty days of community service. Mandatory jail terms for
those with a high blood alcohol level range from ten days to twenty
days.
For
further offenses within the fifteen year time frame the fines and
mandatory jail sentences increase further. If an offense of DUI is
committed with a passenger aged 17 years or younger in the vehicle
then the fines will increase with an additional $500 to $1000, 48
hours community service or 80 hours community service within a
program that has benefits to children.
Cases
of DUI can be very complex and involve much technical evidence.
Hiring a DC DUI lawyer will help you to understand the charges
against you, the likely penalties and how the legal process will
work. A good lawyer will prepare a defense for you with a view to
getting the most lenient penalty possible and will also manage the
case for you. Managing the case is one of the more important aspects
and one which many people would find too stressful and frustrating to
do themselves. There is much paperwork involved in legal cases, as
well as communication with various authorities, witnesses and
official personnel.
Most Michigan DUI lawyers will only work on DUI cases which means they have the
knowledge and experience to best represent you. Other lawyers may
take on the case however, you should satisfy yourself that they have
the experience to present a defense which will result in the best
possible outcome. Many lawyers will offer a free first consultation
where you can find out about them and what will and can happen with
your DUI case.
